Our team have acted for a number of superannuation trustees in the provision of advice on trustee duties and defence of total and permanent disability (TPD) claims.  Trustees have different duties from those of TPD insurers and TPD claims may create conflict when the trustee does not have separate legal representation from the insurer, leading to breach of relevant superannuation legislation.  We provide effective, practical advice and ensure the trustee’s duties to its members are being satisfied and the insurer is acting appropriately in its consideration of TPD claims against by the trustee’s members.
